Look up free Burleigh County public records through official avenues and agencies. Information available to the public includes vital records of marriage, divorce, birth, and death, as well as court cases.
As long as interested parties know where to look, they can efficiently access any of these records, along with criminal history information such as warrants, arrests, inmates, prisoners, probation, and even background checks.
The federal Freedom of Information Act (FOIA) and North Dakota’s Sunshine Laws allow most government-recorded information to be publicly accessible and transparent unless sealed or legally withheld.
While the Sunshine Law provides public access to records, these records can be tricky to obtain if searchers are unsure of which agencies host them or the steps to retrieve them. This resource solves that issue, providing streamlined instructions on quickly and affordably acquiring all types of public records in Burleigh County, North Dakota.

How To Find Out if Someone Is in a North Dakota State Prison via the Department of Corrections
If looking for a state prisoner instead, go to the North Dakota Department of Corrections Resident Search website (the term Resident is used instead of Inmate).3 In order to conduct the inmate (resident) search, you will need the last name (or the first few letters of the last name) of the inmate.
When you scroll down to the bottom of the webpage, there will be a search bar where you may enter the last name or the first letters of the last name. Once you have entered the name, click the Submit button located underneath the search bar.
If the last name entered matches multiple inmates’ names in the North Dakota Department of Corrections records, a list below the search bar will propagate with ID number, last name, first name, and date of birth. The list will allow you to select an individual from the list of inmates by clicking their name.
You can find someone’s mugshot once the name is selected from the list. The mugshot picture is displayed along with the inmate’s name, date of birth, estimated release date, and address and phone number of the facility where the inmate is held. However, this is the extent of information provided about incarcerated individuals. The search will not provide arrest reports or details regarding the arrest.
Although North Dakota does not have a federal prison in its entire state, those serving federal time can be found using their name through the Federal Bureau of Prisons Inmate Locator.4

How To Acquire Burleigh County Vital Records (Marriage, Divorce, Birth & Death)
Vital records pertaining to someone’s birth, relationship status, or death are often needed for identification and other official purposes. Alternatively, some interested parties may simply want to research their genealogy or have these documents for their own records.
While some Burleigh County custodians can provide certain vital records, others must be requested and obtained through the state entities that host them. The information below contains details on how to submit a request, which custodians to turn to, and the fees or stipulations associated with certain record types.
Obtain Marriage & Divorce Records via the Burleigh County Clerk of Court
Marriage and divorce records are considered Burleigh County public records and can be obtained through both county and state agencies.
Searching for Burleigh County marriage records cannot be done online but only by contacting the vital records division of the County Recorder’s Office by mail or in person.
The Burleigh County Recorder’s office is a public records repository and holds the majority of records as they are responsible for filing and maintaining copies.8 An important factor to consider prior to conducting the marriage record search is to ensure that the parties’ marriage license was actually filed in Burleigh County.
The vital records division will help those hoping to check if someone is married, as they have marriage records from 1925 to the present.
There is a fee to request a marriage record. Payment for the marriage record depends on whether the copy you are requesting is certified or not. If you requested a certified marriage record, the fee is $5 for the first copy and $2 for each additional copy. Records will not be mailed until the records office obtains payment first.
If you simply want to find out if someone is married, you can request an uncertified copy; the fee is $1 for each copy. If the purpose of obtaining the marriage record is for the purposes of a name change for a driver’s license, social security card, or any other personal information affected by a name change or change in marital status, then requesting a certified copy will be required.
By Mail:
A search for a marriage record will require you to first submit a request for a marriage record by filling out a short form.9 The form requires the following information:
- Full name of both spouses prior to marriage
- Date of marriage
- Number of copies
- Address where copies are to be mailed to
The completed form, along with the payment for the marriage record copy, can be mailed to:
Burleigh County Recorder

Under case type, if a selection is not made, the search will include all case types. To select a specific case type(s), hold down the Shift key to select a range of case types or hold the control key to select or deselect a single case type at a time. If using a Mac, hold the command button and select the options one at a time.
You may also sort your search by case number, file date, file date rev, status, and defendant’s name. Once you have entered all your required information, you can select search.

Burleigh County birth and death records are not available via any county custodians. Instead, to obtain birth records in Burleigh County, citizens can visit the Vital Records section on the North Dakota Department of Health & Human Services (NDDHHS) website.18
To order a certified copy of birth records from the NDDHHS, citizens can request the records online, by mail, or in person (by appointment or by walk-in).19
Online: To order a certified copy of the birth record for a person who is alive, the person requesting the copy must be the mother, father, or the individual who is named on the birth certificate and must be 16 years or older.
If the person requesting the birth certificate copy is not one of the three people, then you must have a court order with the child’s full name and date of birth or provide legal documentation that lists you as an authorized representative of the individual named on the birth record.
If the person is deceased, the only person who can request the certified copy of the birth certificate has three requirements, as outlined below:
1) You are the parent, child, grandparent, or grandchild. Siblings, uncles, aunts and cousins are not eligible
2) That you be the person who is eligible to request a certified copy of the birth certificate is permitted if the person is an authorized representative acting on behalf of the deceased
3) If the death did not occur in North Dakota, then you are required to submit a certified copy of the death record
You will be required to enter a username and password to order the birth certificate. The next step is to select Add Birth Certificate. Then the webpage will take you to the next step, where it will ask you if the person for whom you are requesting the certificate of birth was born in North Dakota (Yes/No).
Next, you will need to select your relationship to the person named on the birth certificate. The webpage will direct you to the next Yes/No question, which asks if you have a government-issued identification (U.S. State-issued Driver’s License, U.S. State issued photo ID, U.S. Military ID, U.S. Passport, U.S. Visa, U.S. Permanent Resident card, or Tribal ID card).
If you select Yes, then you will be required to enter the expiration date of the government-issued identification.
You will then be required to upload a primary form of identification to prove your relationship to the person named on the birth record.
Once you have uploaded the government-issued identification, the webpage will then redirect you to the next section. Additional information is requested to conduct the search of the record. The information requested includes:
- Full name on the birth certificate (if adopted, then list full adopted name)
- Date of birth
- City or County of birth
- Father’s full name (if adopted, then list full adoptive father’s full name)
- Mother’s full maiden name (if adopted, then list full adoptive mother’s full name)
